SUMMARY:"SEPARATION OF POWERS" Workshop By Adv. Chetan Dhore
DESCRIPTION:UNDERSTANDING THE DOCTRINE OF SEPARATION OF POWERS: A LEGAL STUDIES SESSION\nFOR CLASS XI\nA subject-enrichment session on the “Doctrine of Separation of Powers” was conducted for the students of Class XI Legal Studies at Essence International School\, under the guidance of Directors Mr. Vijay Menon and Dr. Mrs. Hema Menon. The programme was conducted in the gracious presence of the Director Madam Dr. Mrs. Hema Menon and also deeply grateful to Principal Mrs. Beena Menon\, Quality Coordinator Mrs. Jayashri Sastri\, and Vice-Principals Mrs. Arpana Wilson and Mrs. ShashiPrabha Suryawanshi for their endless support and constant encouragement. The session was designed to help students build a conceptual and applied understanding of one of the foundational doctrines of constitutional law prescribed in their Class XI Legal Studies syllabus. \n \nThe guest speaker being felicitated by the Director Madam of Essence International School.\nThe session was addressed by Adv. Chetan S. Dhore\, a practising Advocate with more than 15 years of experience before the Bombay High Court (Nagpur Bench)\, the Principal Seat at Mumbai\, the Supreme Court of India\, District and Sessions Courts\, Consumer Courts\, the Maharashtra Administrative Tribunal\, National Consumer Commission (New Delhi)\, Competition Commission of India\, the National Company Law Appellate Tribunal and other judicial and quasi-judicial authorities. He holds a B.Sc. (Biochemistry)\, LL.B. and an LL.M. in Constitutional and Administrative Law from R.T.M. Nagpur University\, where he is currently pursuing his Ph.D. Adv. Dhore has also served as a Visiting Lecturer at Dr. Ambedkar College\, Deekshabhoomi\, and G.H. Raisoni School of Law\, Nagpur\, and has been a Resource Person at the National Academy for Defence Production (NADP)\, the National Academy for Direct Taxes (NADT)\, VANAMATI\, the Police Department\, Western Coalfields Limited\, and other institutions on various subjects of law. \n \nAdv. Chetan S. Dhore addressing the students on the doctrine of Separation of Powers.\nAdv. Dhore began by introducing the doctrine of Separation of Powers as one of the cornerstones of modern constitutional governance. He explained that the doctrine\, most famously articulated by the French philosopher Montesquieu in his work “The Spirit of the Laws” (1748)\, envisages the division of governmental power among three distinct organs – the Legislature\, the Executive and the Judiciary – so that no single organ accumulates unchecked authority. He traced the philosophical roots of the doctrine to earlier thinkers such as Aristotle and John Locke\, who had also emphasised the need to keep law-making\, law-enforcing and law-adjudicating functions distinct in order to prevent tyranny and protect individual liberty. \nHe then explained the three organs of the State and their respective functions in the Indian context: \n\nThe Legislature: Parliament at the Union level and the State Legislatures\, responsible for enacting laws\, representing the will of the people and holding the Executive accountable through debates\, questions and committees.\nThe Executive: The President\, the Council of Ministers and the administrative machinery\, responsible for implementing and enforcing the laws made by the Legislature.\nThe Judiciary: The Supreme Court\, High Courts and subordinate courts\, responsible for interpreting the law\, adjudicating disputes and safeguarding the Constitution and fundamental rights of citizens.\n\n \nStudents engaging with the discussion on the three organs of the State.\nA significant part of the lecture focused on how the doctrine operates in the Indian constitutional scheme\, which follows a functional rather than a rigid separation of powers\, unlike the United States. Adv. Dhore clarified that while the Indian Constitution does not expressly mandate a strict separation\, Article 50 directs the State to take steps to separate the Judiciary from the Executive in public services\, and Articles 121 and 211 restrict Parliament and State Legislatures from discussing the conduct of judges except in impeachment proceedings. He explained that India instead follows a system of checks and balances\, where each organ\, while performing its own functions\, keeps a check on the others – for instance\, the Judiciary’s power of judicial review over legislative and executive action\, the Legislature’s control over the Executive through the mechanism of collective responsibility\, and the Executive’s role in appointments to the judiciary.\nTo make the doctrine relatable\, Adv. Dhore discussed several landmark judgments that have shaped its application in India. He referred to Ram Jawaya Kapur v. State of Punjab (1955)\, where the Supreme Court held that the Indian Constitution does not contemplate an absolute separation of powers but a broad distribution of functions. He discussed Kesavananda Bharati v. State of Kerala (1973)\, explaining how the doctrine of separation of powers was recognised as part of the “basic structure” of the Constitution\, which even Parliament cannot amend away. He also touched upon Indira Nehru Gandhi v. Raj Narain (1975)\, where the Supreme Court struck down a constitutional amendment for violating the separation of powers by usurping a judicial function\, and briefly referred to the case of I.C. Golaknath v. State of Punjab (1967) to illustrate the evolving relationship between Parliament’s amending power and judicial review. \n\nAdv. Chetan S. Dhore explaining checks and balances among the three organs of government.\nAdv. Dhore also spoke about why the doctrine remains relevant to students of law today\, linking it to the broader principles of rule of law\, constitutionalism and accountable governance. He explained that the separation of powers is not merely an academic doctrine but a living safeguard that prevents the concentration of power\, ensures institutional accountability and protects citizens’ fundamental rights. He encouraged the students to observe how the doctrine plays out in everyday governance – in Parliamentary debates\, in judicial review of government policies\, and in the functioning of independent bodies such as the Election Commission and the Comptroller and Auditor General.\nThe session concluded with an interactive question-and-answer round\, during which students raised queries on the independence of the judiciary\, the scope of judicial activism\, and the practical limits of separation of powers in a parliamentary democracy such as India. Adv. Dhore encouraged the students to read landmark constitutional judgments in the original and to appreciate how constitutional doctrines\, though rooted in theory\, continually shape real institutional conduct. \n \nStudents of Class XI attentively following the session on Separation of Powers.\nThe session was informative\, well-structured and highly beneficial for the students\, strengthening their conceptual grasp of a core topic in their Legal Studies curriculum and deepening their appreciation of constitutional principles that underpin the Indian democratic framework.\nThe session concluded with the guiding message:\n“Power is best safeguarded not by concentration\, but by distribution\, balance and accountability.” \n
